Guest Guest Posted March 12, 2008 Report Share Posted March 12, 2008 Does anyone besides myself think that having a police officer administer a breathalyzer (your form of defense in a DWI case) is a bit of a conflict of interest? I think all breathalyzer's should be administrated by an independent contractor. That is the only way to keep the results unbiased. Power inherently corrupts. We should always be wary and take motions to correct. I can see where you're coming from! But, it is also somewhat of a standardized test. If you drink below or above the legal limit the machine will say so. An officer can't really force the machine to say you blew a .10 if you really only blew a .07 right? Guest Guest Posted March 12, 2008 Report Share Posted March 12, 2008 Well I was taken in for a breathalyzer and couldn't make it work. I have no idea how or why and that was listed as a refusal. The officer gave me no directions and he can't tell me what I did incorrectly. Apparently he doesn't have to. I can't see how this is fair. It was stated that the unit didn't work, and he was accused of refusal, which has many ramifications, and if he wasn't legally intoxicated, that sucks. There is no trick and no possible way an officer could manipulate the machine. Perhaps you subconsciously KNEW you were over the limit and behaved in a way that hindered you from doing what was asked. If you compromise the machine it sees it as a refusal and then you're automatically sunk there too. Really, you don't win either way. In the history of the planet you have never heard of someone that was convicted of something eventually get freed because it was determined that the police manipulated the evidence? Please don't be so naive. My point was if you want the system to be a just as possible, I would hope that would be a goal, than the test should be given by someone else besides the police. This should be a no brainer. It is a digital machine that prints a read out. What do you think the police would do...try to erase and retype the print? Come on. Those machines are tested before, after and consistently to assure they are working properly. Isn't the real problem here a person's belief that it's ok for him/her to get behind the wheel of a car and drive while INTOXICATED?! When your wife, sister, daughter, brother, son, father, mother gets killed by a drunk driver because some selfish know-it-all drove drunk, call me and tell me how you feel then.
