Landmen, Gas Companies, Consultants and LandOwner Groups

 

If you were to look at a table that displays the degree to which that entity has YOUR best interests in mind it would look something like this:

 

Entity Landowner's Best Interests

1) Landowner Highest

2) Landowner Association, Non Profit High

3) Land Services Company, For Profit Medium

4) Hired Landmen retained by Gas Companies Low

5) Gas Companies Lowest

 

 

Be aware of these important facts.

 

1. Whatever you sign from a landman or gas company is a LEGAL CONTRACT and you will be bound by it's terms.

2. Get everything in writing. Verbal promises can and often do change daily.

3 Based on your acreage you could be negotiating a 1/2 million or more deal. You are not buying a car.

 

4. Invest the time needed to fully educate yourself or you might, as many have already, that the $25 an acre bonus you accepted before fully investigating your deal, was worth $2000 an acre or more.

 

5. The lease the landman gives you to sign tips the scales completely to the benefit of the drilling company. It is your responsibility to understand completely what benefits the company is giving themselves, or in a best case scenario, you might have a drill rig pull up to punch a hole through your driveway, or front yard.

 

6. Hiring a local attorney to look over your lease will be of little benefit to you. The companies are banking on the fact that although a regular attorney may be skilled in general law, their working knowledge of Natural Gas Law means they will almost always miss important clauses that will short-change you over the long haul.

 

Consult a general attorney for your normal legal issues.

Consult a criminal attorney if you get in trouble with the law.

Consult a gas/oil attorney to negotiate the terms of your lease.

 

Either join or form a landowners group, the benefits are unbeatable.

 

A Larger contiguous block of land area commands a stronger position to negotiate terms of the lease.

The "two heads are better than one" addage is no more true than in considering leasing land for natural gas and oil exploration.

Retaining a qualified gas lease attorney is expensive. $350 an hour is not unusual for the top lease attorneys. Unless you have megabucks yourself, a landowner group can share the expenses.

This community is not against the gas drilling companies. As a matter of fact, we are thrilled to see such a valuable opportunity happen to so many people. Think about why you bought your land or what you enjoy about it and work with a landowner group to negotiate the best terms for you, your land and your heirs. If we are successful, we will have achieved a balance of winning for both the landowner AND the company.

Our group is growing!..we have over 10,000 acres in the Town of Binghamton and Conklin in our group. Due to overwhelming response, we have extended the deadline to join the group until May 19. After that, we will accept additional parcels on a waiting list only basis.

 

There is a meeting on May 15th, 2008 at 7:00 pm at the Brookside School on Saddlemire Road for the Binghamton-Conklin Landowners Group. Attorney Christopher Denton, Associate Attorneys, and their staff will be here to discuss our plan moving forward and answer questions.
