It's not right at all. If they are not solely working for the school system a set number of hours a week, then it is wrong. Do they have an office in the school? Do they punch a time clock? Would a sub contractor be entitled to benefits?

They really have to "bend their minds" to find any possible way to legitamize this mis-appropriation of taxpayer funds. Cuomo should go after them with everything he's got.

I mean, COME ON. The company I work for has a law firm on retainer and we don't pay their medical benefits or provide them with pension benefits. ( I suppose we do through their fees...but not directly.)

They should have to pay back any and all insurance premiums and pension benfits paid!

The rate they get paid for billable hours more than covers the benefits they can buy for themselves. They are "small business" people in their own right and can expense it themselves. Do they consider themselves to be full time workers at their own law firm? This is taking advantage of taxpayers and the school officials are condoning it!

The lawyer and his law firm should be ashamed of themselves. Not all local lawyers and law firms in the area take advantage like they do. With school budgets all amuck this can not help. All Hogan..... schools need to jump ship and go to an attorney of firm that "takes the high road". B)

Why shouldn't they get benefits? They work for the school system don't they.Heck, give them 3/4 pay when they retire too.I mean it's a full time job for the lawyer so why shouldn't they get it if they are employed by the system?

The point is that they are NOT EMPLOYED by the schools. They are on retainer. Review the school employee wage guides on the press sight and you will not find any lawyers on the payroll.

They are employees of the law firms that they work for. The law firms should paid their medical insurance and pension benefits - not taxpayers.

It's actually much more complex than that. Doctors and Lawyers were permitted some time ago to participate in the system and it's a fairly common practice. It may rub you personally the wrong way but that's not the same thing as being illegal. This is about someone trying to fill Spitzer's shoes with an 'investigation' that gets people's interest. Watch for a while and see if you were duped into being a tool.

Yes, it is much more complex than that. The practice of enrolling lawyers into the school's employee benefits programs was purposefully hidden from taxpayers. It was done through the concerted efforts of the attorneys and school administrators. Why else would they not list the attorney's as employees of the school? They counted on "John Q. Public" being ignorant of the practice.

Where is the daylight?

Do you consider everyone that questions mis-appropriation of public funds to be a tool? Did you ever consider that the Attorney General is just doing his job?

Attorneys’ retirement benefits revoked in NY pension probe

New York Comptroller Thomas DiNapoli says his office is kicking four attorneys’ out of the New York state and local retirement system because they were inappropriately classified as employees by an upstate BOCES district.

The move is part of a broader investigation that started with findings some Long Island school districts were listing outside lawyers as employees, allowing them to qualify for public pensions while their private practices collected millions in legal fees.

DiNapoli says the office also revoked five years of service credit for another lawyer the Hamilton-Fulton-Montgomery BOCES incorrectly reported as an employee.

DiNapoli says his office will return retirement contributions local governments paid for the attorneys, who all worked for the same firm.

This is a start.
