The case concerns Washington D.C.: They want all handguns banned, and if you have rifles and shotguns they want them unloaded and either have trigger locks or have weapon dissassembled in your residence!!!!

Yes, this case is about DC, but the ruling will have far reaching effects. If they rule for the gun owners, it would set up challenges for the next 20 years. A win would provide a base for lawsuits for places such as Cook County, IL's ban on handguns to NY's restrictive laws.

Yea - I think I should be able to own and use myheat seeking anti aircraft missle launcher, even though I have spent 10 years in a mental ward for severe mental illness. For some reason, no one but the NRA agrees with me.

If the police can't protect me from EVERY ATTACK, 100% of the time, the government has NO BUSINESS taking my guns away. NONE.

The way the Suit and Appeal is being presented it is not only a DC issue.

 

 

This is the first time the Supreme Court will need decide if the Second Amendment refers to INDIVIDUAL Rights as the other nine do.

 

They have already dissembled in the cases of Mc Cain-Feingold and KELO, and bastardized and weakened all of the Bill of Rights so we can only Pray. We can only Pray Justice Kennedy for a change looks at the Constitution and Bill of Rights for guidance rather than the EU and UN.

I dont know if you read my post - but it would seem that we are on the same page. How dare they try and tell me I can not have my anit aircraft heat seeking missle!! Now I know I have spent time in jail and 11 years in a mental insititution and all, but how dare they!

I was listening to the C-Span coverage... Interesting! We may get to own Machine Guns. A modern day Militia to protect ourselves from a Socialist Obama type Govt. or invasion by say the Chinese - some on the court seem to feel a modern day Militia would include Machine Guns as legitimate arms!

It'll be a long wait until June for the courts decision. No matter the courts decision criminals will still possess guns.

Well one thing that sets DC apart is that it is not a state. As of current precedent the 2nd amendment does not apply to states but it does apply to the federal government which controls DC. The local government of DC exist only because congress allows it and everything it does is subject to approval by congress.

The 2nd Ammendment does not apply to states? It applies to ALL of the US, District of Columbia included. I'm tired of government entities whittling away at my constitutional rights!

It apply to all US law, not state law. Most of the amendments have become applicable to the states incorporation through 14th amendment. The 2nd has never been incorporated into the 14th... so as of now it does not apply to the state government. So in theory the states culd take away all guns. Before the 14th amendment the states were not required to follow the previous bill of rights.

 

1st Amendment: Fully incorporated.

2nd Amendment: No Supreme Court decision on incorporation since 1876 (when it was rejected).

3rd Amendment: No Supreme Court decision; 2nd Circuit found to be incorporated.

4th Amendment: Fully incorporated.

5th Amendment: Incorporated except for clause guaranteeing criminal prosecution only on a grand jury indictment.

6th Amendment: Fully incorporated.

7th Amendment: Not incorporated.

8th Amendment: Incorporated with respect to the protection agains "cruel and unusual punishments," but no specific Supreme Court ruling on the incorporation of the "excessive fines" and "excessive bail" protections.

I have the Martha Stewart reloading kit for my 9mm ammo, hard to keep the powder dry in this rainy weather though. Sort of funny that everyone thinks all I keep in my cellar is canning supplies! ;)
