NY Legalizes Marijuana

New York employers are no longer allowed to drug test most workers for marijuana, the state Department of Labor (DOL) announced in new guidance.

While many legal cannabis states have made it so workers can’t be penalized for testing positive, New York appears to be the first to explicitly bar employers from testing for THC at all—with limited exceptions for certain categories of workers.

Employers can still punish people for being actively impaired on the job, but the new rules create a high threshold for proving impairment, going so far as to say that the odor of cannabis is not enough on its own to be used as evidence.

New York Bill Would Allow Marijuana Industry to Deduct Business Expenses On State Taxes

“This bill will provide tax equity to the emerging cannabis industry by allowing licensed cannabis businesses to make ordinary and necessary deductions on their New York state taxes,” says a memo from bill sponsor Sen. Jeremy Cooney (D). “Additionally, it ensures the adult-use cannabis market will not be dominated solely by large multi-state operators who can afford to pay the higher effective tax rate.”

From a quick read, it appears that they're just allowing them to file their taxes like every other business.

State taxes usually incorporate a large portion of the federal tax code by reference. Since marijuana businesses are not recognized by the federal tax code, they can't deduct their inventory expenses, etc., and that was incorporated into NYS law as a result.

NY’s top cannabis regulator voices bullish timeline for adult-use launch

New York’s top cannabis regulator said this week she hopes the state can adhere to an 18-month timeline from last March’s enactment of adult-use marijuana legislation to roll out the expected billion-dollar program.

That would seem to indicate hopes that sales could start by late 2022, rather than 2023 as many now expect. The 2021 MJBizFactbook projects that recreational marijuana sales will reach $1.1 billion in the first year of the program and $2.1 billion annually by the fourth year.

    New York stands to generate more than $1.25 billion in marijuana tax revenue over the next six years, according to an estimate included in the governor’s executive budget that was released on Tuesday. 
     
    Revenue from the nine percent state excise tax on cannabis will go to education (40 percent), community reinvestment (40 percent) and drug treatment (20 percent). Another four percent tax will support counties (25 percent) and cities, towns and villages (75 percent) that allow marijuana businesses to operate in their jurisdiction.

The NYS lottery proceeds were supposed to go to schools.  All they did was allocate the money from the lottery for schools and they reduced the amount of funds from the taxpayers that went to schools.

 While New York's much-anticipated legal pot shops could be a year away from opening, the state is making medical marijuana much more available now.

As of late last month, clinicians can greenlight medicinal pot for any condition they think it would help, not just for a limited list of ailments. In the last few months, the state Office of Cannabis Management also has expanded the ranks of providers.

The company-paid medicinal marijuana tax is lower than the upcoming recreational pot taxes, to be paid by wholesalers and consumers. “A lot of people say, ‘Well, what do you need a medical card for now? It’s legalized,’” Hamilton said. But she expects many patients will continue to prize the pharmacists, precise formulations and tax break at dispensaries.
