While many legal cannabis states have made it so workers can’t be penalized for testing positive, New York appears to be the first to explicitly bar employers from testing for THC at all—with limited exceptions for certain categories of workers. From a quick read, it appears that they're just allowing them to file their taxes like every other business. State taxes usually incorporate a large portion of the federal tax code by reference. Since marijuana businesses are not recognized by the federal tax code, they can't deduct their inventory expenses, etc., and that was incorporated into NYS law as a result. That would seem to indicate hopes that sales could start by late 2022, rather than 2023 as many now expect. The NYS lottery proceeds were supposed to go to schools. All they did was allocate the money from the lottery for schools and they reduced the amount of funds from the taxpayers that went to schools. As of late last month, clinicians can greenlight medicinal pot for any condition they think it would help, not just for a limited list of ailments. In the last few months, the state Office of Cannabis Management also has expanded the ranks of providers. The company-paid medicinal marijuana tax is lower than the upcoming recreational pot taxes, to be paid by wholesalers and consumers. “A lot of people say, ‘Well, what do you need a medical card for now? It’s legalized,’” Hamilton said.
